for Producers & Distributors


Errors & Omissions (E & O) Insurance for Producers offers specialized coverage for a wide variety of media risks against the devastating impact of lawsuits for libel, slander, invasion of privacy, infringement of copyright and other specified torts. Typically required when signing a distribution or broadcast contract, your project is submitted to all eligible, top-rated insurers, in search of the most competitive premium. Distributors typically define project specific coverage for features, documentaries, TV Special & Series.  These described policies name the productions specifically.  E&O Provides coverage for (but is not limited to);

  1. Improper handling of unsolicited scripts

  2. Use of hidden cameras

  3. Failure to obtain appropriate rights for music and film clips

  4. Failure to obtain appropriate releases for individuals appearing in the production

  5. Improper use of celebrity's name or likeness


Distributor’s E&O Insurance Similarly to the producer’s E&O insurance, Distributor’s Errors and Omissions (E&O) insurance indemnifies media distributors from lawsuits that may arise due to the content of the material they are distributing.

Distributor’s E&O insurance provides protection for media distributors (corporations, individuals and partnerships) from lawsuits that allege:  

  • Invasion of privacy

  • Plagiarism or pirating of ideas

  • Infringement of copyright

  • Libel or slander

  • Degrading or defamation of products (trade libel)

  • Infringement of trademark, slogan or title


Distributor’s E&O insurance differs slightly from Producer’s E&O in that distributors are insured for a list of titles they are distributing. So, under distributor’s E&O insurance, a distributor is indemnified against lawsuits arising from the content of Movie X and will still be indemnified against lawsuits alleging content errors for Movie Y.

The available policy types are as follows:

Occurrence-Basis E&O Policy: An Occurrence basis policy affords coverage in perpetuity to claims arising from scheduled titles that incur covered claims from the scheduled title that meet the policy criteria for a trigger or an acceptable occurrence. Typical occurrences for these types of claims, depending on the actual policy terms, may include the sale, distribution or broadcast of the Scheduled Title.

Claims Made E&O Policy: has provisions that dictate that the claim must be made during the policy period. Although this may translate into a slight premium saving, this policy type requires that the policy is renewed or remains in force for multiple years for coverage to apply.

In most cases, if an occurrence policy form is available, it may serve your needs best.

Publishers, Bloggers Liability / Errors & Omissions Publisher’s liability Insurance is for a publisher of any size or type: small, large, book, magazine, newspaper, trade, directory, music, greeting cards and calendar, electronic (Internet), print-on-demand, CD ROM, audio book or a freelancer, writer or an author. Publisher’s liability insurance is also referred to as media perils liability insurance, publishers or authors errors and omissions protection.

How Much Does Errors and Omissions (E&O) Insurance Cost?

While every project and policy are different, ballpark premium pricing for producers E&O premium starts at $2500.00 for a $1,000,000 limit per occurrence and in the aggregate with a deductible of $10,000 per occurrence for video on demand, DVD-type non-theatrical distribution.  Higher limits and deductibles as well as theatrical distribution policies are available.  Please note each E&O application is separately underwritten and priced primarily based on production budget, clearances being in place, subject matter as well as the type of distribution.  Although we do our best to give you the cheapest rate possible, we also want to give you the best policy available.  Film Emporium’s brokerage team contacts all markets on your behalf to provide the lowest priced E&O insurance premium and best coverage option for your project.
